4K Global protested Army’s award of a contract to Roundhouse PBN, arguing the government unreasonably found its proposal ineligible for award. 4K Global argued that it was not required to submit a final, signed PLA with its proposal (a project labor agreement is a preaward collective bargaining agreement that establishes terms and conditions of employment for a specific construction project).

GAO found that the RFP required offerors to submit a PLA that met the minimum requirements of FAR 52.222-33(c) and that 4K Global’s PLA did not meet this requirement, because it did not identify any subcontractors that agreed to be bound by the PLA. 

The protest was denied because the agency reasonably rejected 4K Global’s proposal based on the submission of a noncompliant PLA.
