Emerge Solutions Group, LLC, filed a postaward protest of the Defense Health Agency’s RFQ No. HT001124R0041 for development, operations, and maintenance of clinical systems and data processing, arguing the solicitation unlawfully omitted FAR 52.222-46, Evaluation of Compensation for Professional Employees.
GAO dismissed the protest as untimely, because any alleged defect was apparent in the original 18 June 2024 RFQ, and the protest was filed after the 15 August 2024 due date. A DHA email after the closing date confirming no price realism and no compensation plan requirement merely reiterated the original RFQ approach and did not trigger a new protest clock.
