Mission Analytics, LLC, requested reconsideration of GAO’s earlier dismissal of its protest concerning the NIST’s RFQ No. 1333ND24QNB770135 for a direct view LED display system. Mission Analytics initially argued that the RFQ was defective, because it omitted FAR provision 52.204-22, Alternative Line Item Proposal. GAO dismissed the protest because FAR Part 12, which governs commercial item acquisitions, does not require inclusion of that provision. In its reconsideration request, Mission Analytics alleged that GAO misapplied FAR 12.301 and ignored subsections that might permit broader incorporation of provisions.
GAO reviewed the reconsideration arguments and found no basis to change its decision. While Mission Analytics insisted that FAR 12.301(a)(1) and (2) could require other clauses, GAO emphasized that it had already considered and rejected that argument. Repetition of prior arguments and disagreement with the outcome did not meet the strict standard for reconsideration. GAO affirmed that FAR 52.204-22 is not mandatory under FAR Part 12 procurements and that the RFQ properly included all required provisions through FAR 52.212-1.
