Case overview:
Mission Analytics, LLC, sought reconsideration of GAO's earlier decision denying its protest of an Air Force contract award to ThunderCat Technology, LLC, for technology upgrades to an auditorium at Travis Air Force Base. Mission Analytics argued the original GAO decision contained errors of fact and law, particularly regarding the Air Force’s evaluation of its technical proposal (allegedly for not detailing installation of a confidence monitor) and the price analysis of the awardee’s proposal. The requester reiterated contentions that its agency-level protest was improperly dismissed and that the price evaluation relied on an unsuitable comparison. GAO denied the request because Mission Analytics failed to show any material errors of fact or law or to introduce new information—as required for reconsideration under GAO regulations.
This is a textbook example of the high bar for GAO reconsideration—unless new evidence or legal error is shown, arguments simply repeating earlier protest points will not succeed.
