Roku Management Consulting, LLC (RMC), protested the Navy’s exclusion of its proposal from the competition under RFP No. N3220525R4034, seeking financial management support services for Military Sealift Command. RMC asserted the Navy applied unstated evaluation criteria by requiring disclosure of dollar values for prior contracts and by applying a $10M size threshold that, according to RMC, was not in the solicitation. However, GAO found the solicitation unambiguously required offerors to demonstrate relevant experience with contracts of at least $10M in value, and to “detail” their organizational experience, requiring contract information and values. RMC did not include any contract numbers or values in its proposal, nor did it respond to GAO’s request for further justification after the agency moved to dismiss.
Meanwhile, RMC’s challenge to system-specific requirements was dismissed as untimely, as solicitation concerns must be protested before the proposal submission deadline.
The protest was dismissed because it failed to state a valid basis; all RMC’s arguments relied on mischaracterizations of the solicitation or were otherwise procedurally barred.
