TYD Services, the incumbent contractor based in Doha, Qatar, protested the Army Corps of Engineers’ award of an RFP for the lease of sport utility vehicles and related services in the US Central Command Qatar area of responsibility. Much like Road Hero, TYD challenged its exclusion from award for technical unacceptability after failing to submit required details about the vehicles—type, make, model, and specifications—as well as not providing the needed confirmation of compliance with the performance work statement (PWS). TYD further objected to being eliminated over omissions in the required pricing worksheet, arguing that these should have been clarified as minor issues or through discussions, particularly as an established incumbent.

GAO found that the Corps reasonably followed its evaluation procedures, which explicitly required detailed technical and pricing information with no guarantee of discussions. Because TYD’s proposal failed to include essential details and did not complete the pricing worksheet, the agency properly deemed the offer technically unacceptable.

In denying the protest, GAO reinforced that agencies can make award without discussions where the RFP so states, and offerors have no entitlement to clarification opportunities to fix material omissions postsubmission, especially when such fixes would require substantive proposal revisions.
