Avalon Contracting, Inc., a service-disabled veteran-owned small business, protested the award of a maintenance contract by the US Army to Tiya Support Services, LLC. Avalon alleged improper evaluation of past performance, asserting that the agency ignored the contributions of its teaming partner BryMak & Associates. Avalon also argued that Tiya failed to disclose adverse past performance issues.
Evaluation of teaming partner’s past performance: Avalon claimed that BryMak, identified as a teaming partner, should have been considered as part of a "proposed collective." GAO determined that BryMak was listed as a subcontractor in the proposal, which the solicitation explicitly excluded from past performance evaluations.
Adverse past performance: Avalon alleged that Tiya failed to disclose issues related to past contracts. GAO found no merit in this argument, as none of the incidents cited resulted in ratings below satisfactory in Tiya's performance records.
The protest was denied, reaffirming agencies’ significant discretion in evaluating past performance in accordance with solicitation terms.
