The US Air Force requested that GAO modify its prior recommendation in ATP Gov, LLC (B-422938, B-422938.2), where GAO sustained a protest challenging the issuance of a delivery order to iGov Technologies, Inc., for satellite terminal assemblies. GAO had found that iGov’s proposed equipment did not meet the solicitation’s material requirements and recommended either reevaluating proposals or revising the solicitation. USAF instead sought to pay ATP’s proposal preparation costs in lieu of corrective action, arguing that reevaluating proposals or amending the solicitation would cause unacceptable delays and costs.

Untimely request for modification of remedy: GAO dismissed the request as untimely, because USAF filed it more than a month after GAO’s 12 December 2024 decision—well beyond the ten-day deadline for reconsideration. GAO also noted that USAF's continued contract performance in the interim likely increased termination costs, undermining its own arguments for modifying the remedy.

GAO dismissed the request, because USAF failed to timely request reconsideration and could not now argue for an alternative remedy.
