DS Imports protested the Department of Transportation's Great Lakes St. Lawrence Seaway Development Corporation's award to Marine Structures for trapezoidal marine rubber fenders and mounting hardware. The protester argued the agency unreasonably evaluated its quotation.

GAO dismissed the protest as factually and legally insufficient. DS Imports' initial protest consisted entirely of stating it had "designed both of these fenders" previously and an attached performance letter. The agency found DS Imports' quotation technically unacceptable, because its shop drawings for rubber fenders failed to show required holes or their location and tolerances, and included dimensional tolerances that were too large compared to solicitation drawings.

Additional allegations raised in comments were dismissed as untimely, filed more than ten days after the protester knew the basis for the evaluation.

The protest was dismissed for failing to demonstrate improper agency action and for untimely allegations.
