ECC Infrastructure, LLC, protested Navy’s issuance of a task order to TPC-NAN Joint Venture for design and construction of waterfront repairs at Apra Harbor, Naval Base Guam. ECC challenged the agency’s evaluation, including its assessment of deficiencies.
Failure to propose required marine concrete: ECC’s quote did not commit to using marine concrete or any reinforced concrete, despite solicitation requirements mandating its use in critical areas. GAO found the solicitation unambiguously required marine concrete and rejected ECC’s argument that the requirement was discretionary.
Proposal ineligibility due to deficiencies: Navy assessed two deficiencies in ECC’s quote: (1) failing to comply with marine concrete requirements and (2) transition zones. As the solicitation stated a proposal with a deficiency would be ineligible, GAO upheld the agency’s exclusion of ECC’s quote from consideration.
Protest denied.
