KE System Services protested an Army award for kitchen hood preventative maintenance and repair services. But the protest never got off the ground because the procurement was conducted on a lowest-priced, technically acceptable basis and KE’s own proposal had been found technically unacceptable.

GAO dismissed the protest for lack of interested-party status. KE did not timely challenge the evaluation of its own proposal as unacceptable, and the record showed there was another technically acceptable offeror that would have been next in line for award even if KE had succeeded in attacking the awardee. Under GAO’s standing rules, that made KE’s economic interest too remote to pursue the protest.

The decision also noted problems with inaccurate legal citations in KE’s filings and warned against relying on AI-generated legal material without verifying it. The protest is dismissed.
