Military Operational Systems protested GSA’s award for battery recovery and storage shelters, arguing the awardee misrepresented its product and would not actually provide shelters meeting the RFQ’s material requirements.

GAO dismissed the protest. The awardee’s quotation expressly promised a compliant product, including the required automatic functionality and pulse-technology features. Once the agency reasonably relied on that representation in making award, any later dispute about whether the contractor will actually deliver conforming shelters becomes a contract administration issue—not a bid protest issue.

That meant GAO would not police predicted performance failures at the protest stage.

Protest challenging the agency's evaluation of the awardee's quotation as technically acceptable is dismissed where the awardee proposed to satisfy the solicitation's material requirements; whether the awardee will actually supply compliant end products is a matter of contract administration not subject to review by our Office.
