Mission Analytics, LLC, a small business based in Falls Church, Virginia, requested reconsideration of GAO’s earlier decision dismissing its protest of a Department of Commerce RFQ for a direct view LED display system issued by NIST. Mission Analytics had claimed that the agency improperly awarded a purchase order while its agency-level protest was pending, allegedly violating FAR §33.103(f). GAO dismissed that protest in December 2024, finding no protest was pending at the time of award and that no competitive prejudice occurred. Mission Analytics sought reconsideration, asserting material errors of law and fact in GAO’s original decision, including misapplication of FAR §19.507(h) and reliance on an OHA decision outside its jurisdiction.
GAO reaffirmed that the agency’s decision to proceed without taking corrective action effectively resolved any agency-level protest, citing precedent and acknowledged a minor word substitution (using "should" instead of "shall" from FAR 52.219-33) but found it immaterial.
The request for reconsideration was denied. GAO found no material errors that would have altered the protest’s resolution and reiterated that procedural concerns without prejudice do not support sustaining a protest.
