Oready asked GAO to reconsider an earlier dismissal of its protest as untimely in a Bureau of Land Management procurement for online auction services. The earlier case turned on filing deadlines during a GAO shutdown period, and Oready argued its later protest should have been treated as timely or excused because of EPDS access issues and because a later agency response supposedly created a new accrual date.

GAO dismissed the reconsideration request as untimely and, in any event, meritless. The filing hit EPDS after the 5:30 pm Eastern deadline, so it was deemed filed the next day. GAO also found no systemwide EPDS failure during normal hours and noted Oready waited until just minutes before the deadline to try to file, then failed to use the backup procedures for email filing.

GAO further held that Oready’s newer arguments about a later agency response and the shutdown notice could have been raised in the original protest and therefore could not support reconsideration. The decision is a straightforward reminder that timeliness rules and EPDS filing rules are enforced strictly.

The request for reconsideration is dismissed.

GAO dismissed Oready’s reconsideration request after it missed the EPDS filing deadline and failed to show a system outage or any valid basis to reopen the timeliness ruling.
