Solvere protested a Navy SeaPort NxG task order award to EHS Technologies for IT services, challenging the evaluation of its personnel approach and cost proposal. GAO sustained the protest.

The most important issue was the agency’s treatment of nonkey personnel. The solicitation expressly allowed offerors to use “TBD” for unidentified nonkey staff, yet the Navy assessed Solvere a significant weakness in part because too many of those positions were unidentified and lacked certifications. GAO held that approach was inconsistent with the solicitation as written. GAO also found a separate flaw in the Navy’s cost evaluation under the terms of the RFP.

Because those errors could have affected the best value tradeoff, GAO sustained the protest.
