Oready protests the terms of an Interior Department, Bureau of Indian Education RFQ for occupational therapy services at Mariano Lake Community School in Crownpoint, New Mexico. The solicitation sought an occupational therapist and an occupational therapy assistant for the 2025–2026 school year and required vendors to submit resumes and signed letters of commitment for key personnel.
Oready argued these requirements were unduly restrictive of competition, disadvantaging small businesses that cannot afford to recruit and retain specialized staff without assurance of award. Oready contended the agency should have accepted post-award recruitment plans instead.
GAO denied the protest. The Bureau demonstrated that the key personnel requirements were reasonably necessary to ensure properly certified, vetted staff were in place by the start of the school year. The agency cited past experience with performance issues, compliance risks, and service delays when vendors were not required to identify committed staff before award. GAO noted the agency is not required to document its consideration of less restrictive alternatives—only to establish the requirement as reasonably necessary. Oready's preferred alternative of post-award recruitment plans was not shown to meet the agency's needs.
The protest is denied.
